Censoring Language as Offensive Violates the Constitution

American Thinker
By Michael Bargo, Jr. | 3 November 2016

The concept that language and actions should be censored or banned outright by public schools and public spaces because some persons may be offended violates the U.S. Constitution in many ways.

One, the most obvious one, is that it allows a tiny group of people to say they are offended and thereby censor the language of others. The First Amendment does not say that the freedom of speech can be infringed by somebody claiming to be offended by the exercise of someone else’s speech. This standard of personal feeling is not written anywhere into any right protected by the Constitution. Feelings are not relevant — they simply are not mentioned as variables that influence legislation. If they were, people should have the power to shut down government regulations because they were offended by them. But, curiously, those who promote using the concept of personal offense never speak of limiting government, only limiting the people.

Evidence of this is that we are told no matter how many people are offended by government mandates or Supreme Court decisions, such as same-sex marriage, the fact that people are offended doesn’t have any standing when standing in the way of the rights of others being expanded. The people can’t influence government on the basis of being personally offended, only government bureaucrats can use this strategy.

This leads into the second important Constitutional issue regarding the offensive language standard: the 14th Amendment. The 14th Amendment says that no state can pass a law that denies anyone equal protection. This means that a tiny group of people cannot have a right to censor language as offensive, and no one else. So far no one has explained, in constitutional terms; why one person, who claims to be offended, has the right to shut down the speech, clothing, or legal actions of everyone else.

Seattle Teachers Enforce Black Lives Matter Indoctrination

FrontPage Mag
October 17, 2016 | Matthew Vadum

A Maoist-style reeducation fest approaches in Seattle schools.

blm-tshirt
Thousands of taxpayer-supported Seattle teachers are planning to don Black Lives Matter t-shirts this week in public schools and force-feed left-wing propaganda to their students about race in an effort to draw attention to the systemic racism they imagine is embedded in the public education regime.

The shirts say “Black Lives Matter” and “We Stand Together,” which is almost identical in meaning to the Hillary Clinton campaign slogan “Standing Together.”

The Black Lives Matter cult is animated by a hatred of normal American values. Its members idolize convicted, unrepentant black militants and cop-killers Assata Shakur and Mumia Abu Jamal and have declared “war” on law enforcement. Its members openly call for police officers to be assassinated. Sympathizer Micah X. Johnson answered the call murdering five cops in cold blood during a Black Lives Matter rally in Dallas in July. Black Lives Matter, which is vehemently anti-white, ought to be designated a domestic terrorist organization for fomenting a war against police, critics say.

The October 19 event is being run by Social Equality Educators (SEA), a group of teachers within the Seattle Education Association (SEA), a local collective bargaining unit. A political faction, SEE runs candidates for offices in the SEA.

Black Lives Matter Infiltrating Public Schools

FrontPage Mag
October 18, 2016 | Joseph Klein

Teachers engage in week-long protest to promote a movement built on race hatred.

The toxic Black Lives Matter narrative is continuing to infiltrate our mainstream culture. It is even finding its way into our public schools. Case in point is the plan by about 1000 teachers in the Seattle public school system, with the strong backing of the school system administration, to wear “Black Lives Matter” T-shirts this week. Some of the educators’ t-shirts include a raised fist, not exactly a symbol of racial harmony and peaceful dialogue.

The participants in this solidarity “wear-in” also want a school curriculum that indoctrinates students to counter what one Black Lives Matter activist and Seattle high school teacher, Jesse Hagopian, called “institutional racism”and the “multiple oppressions that our kids face.” Hagopian opposes standardized testing as an example of such institutional racism.

The Seattle Education Association (SEA) Representative Assembly passed a resolution unanimously supporting the Black Lives Matter initiative. The SEA is a public teachers’ special interest organization. Its resolution stated that SEA will “endorse and participate in an action wearing Black Lives Matter t-shirts on Wednesday, October 19, 2016 with the intent of showing solidarity, promoting anti-racist practices in our schools, and creating dialogue in our schools and communities.”

The superintendent of schools also supports the demonstration of solidarity with Black Lives Matter on school premises.

The Seattle school system is not the bastion of “institutional racism” that Black Lives Matter and its supporters are making it out to be. Seattle is one of the most progressive cities in the nation. Its school district had passed a landmark “Ensuring Educational and Racial Equity Policy” in August of 2012, which called for the elimination of “the racial predictability and disproportionality in all aspects of education and its administration.” It also mandated the use of a Racial Equity Tool to ensure that “race be clearly called out and institutional and structural racism be addressed within our own organization.” The intent was to devise policies and curricula that close the “opportunity gap” holding students of color back.

‘After School Satan’ Could Be Coming to Your Kids’ Elementary School

The Satanic Temple is going after your children. A new after school program called “After School Satan” will launch across the country this year.

But the program isn’t about worshipping Lucifer. In fact, the ironically named Satanic Temple doesn’t even believe in his existence. As Doug Mesner, the Temple’s co-founder, explained, “Satan” is a “metaphorical construct” intended to represent rejection of all forms of tyranny over the human mind.

“We think it’s important for kids to be able to see multiple points of view, to reason things through, to have empathy and feelings of benevolence for their fellow human beings,” the Temple’s Utah chapter head, who goes by the name Chalice Blythe, told The Washington Post.

The curriculum emphasizes reasoning and social skills, according to the Post. The Temple says meetings will include a healthy snack, a literature lesson, creative learning activities, a science lesson, puzzle solving, and an art project.

The Satanic Temple won’t enroll your child without your permission —each child must have a signed parental permission slip to attend. There will be clubs in Atlanta, GA; Los Angeles, CA; Pensacola, FL; Portland, OR; Salt Lake City, UT; Seattle, WA; Springfield, MO; Tucson, AZ; and Washington, DC.

Despite its entirely secular focus, the Satanic Temple framed its new project in opposition to “Good News Clubs,” a Christian evangelical program that traces back to 1937.

Insanity | Neglect, Abuse, Rape, Murder of Children

Mother, boyfriend and cousin are arrested for brutal rape and murder of girl who was injected with meth, stabbed, strangled, dismembered and set on fire on her 10th birthday

On the day a girl was going to celebrate her 10th birthday, she was found murdered in her family’s apartment in New Mexico by police officers, her dismembered remains wrapped in a burning blanket.

Mother ‘stood by and watched’
The scene Wednesday morning in apartment number 808 of the Arroyo Villas complex was like something out of a horror movie. A man and a woman had allegedly drugged a little girl, then raped, killed and dismembered her.
Most would expect the girl’s mother to fight with everything she had to save her daughter. But Michelle Martens, according to her own reported account to police, is not that kind of mother.
In her statement to police, it appears that Martens wanted to watch as her boyfriend, Fabian Gonzales, 31, and his cousin Jessica Kelley, 31, raped her 10-year-old daughter Victoria Martens before killing her and trying to dispose of her body.

Mother of 10-year-old girl found dismembered on her birthday ‘offered her daughter to be raped by strangers online and by colleagues’
The mother of a 10-year-old New Mexico girl found dead and dismembered told police she sought men online and at work to sexually assault her daughter.
Michelle Martens told police that she had set up encounters with at least three men to sexually assault her daughter, Victoria Martens, the Albuquerque Journal  reported.
Michelle, 35, told investigators that one of the men was a co-worker. Two others she met online, including Fabian Gonzales, 31. He was to be the last.

Army supervisor and mother-of-three, 26, is fighting for her life after she was set on fire ‘by a disgruntled employee whom she feared’
A civilian employee at an Army hospital at Fort Leavenworth in Kansas has been charged with dousing his boss with gasoline and setting her alight in a shocking attack that left the victim clinging to life.
The incident took place last Wednesday at the Munsion Army Health Center, where federal investigators say the suspect, 54-year-old Clifford Currie, assaulted his supervisor, 26-year-old First Lt Katie Ann Blanchard.
Blanchard, a married mother of three boys, all under the age of five, suffered third- and fourth-degree burns to her head, neck, back, arms and hands, according to the description of a GoFundMe campaign launched by her friend.

High School Bans American Flags To Be ‘Inclusive.’ It Didn’t Go Over Well.

From The Daily Wire
By James Barrett | May 19, 2016

american_flags_high_school

For the sake of “inclusivity” and protecting students from being “offended,” a Colorado high school informed students last week that they were forbidden from flying any flags, including the American flag, in the parking lot. The next day, five seniors decided to stage a pro-freedom of speech, pro-America demonstration, proudly flying Old Glory in protest of the new policy. Following mounting public pressure, the school has since walked back its ill-conceived ban.

The flag ban at Fruita Monument High School reportedly came in response to a student who chose to fly a Confederate Flag behind his vehicle, something school officials deemed offensive to other students. The administration’s solution: ban all flags. Students who disobeyed faced consequences, including the potential to be barred from walking in the graduation.

“They said we can’t fly a Mexican flag, Confederate flag, American flag, any flag at all,” said one of the senior protesters. “Whoever has a problem with our county’s flag really shouldn’t be here, and really shouldn’t say anything about it, because if they don’t like our country why are they here?”

How The Transgender Pronoun Mandate Makes Teaching More Dangerous

From The Federalist
By M.G. Oprea | May 19, 2016

For a teacher, every day is a day you could lose your job because you said the wrong thing accidentally. The new federal transgender ‘guidelines’ make that worse.

trans

Among the Obama’s administration’s guidelines released last week for how to treat transgender students, teachers and staff are instructed to refer to each boy or girl as “he” or “she” depending on the child’s gender identity, not his or her biology. Not to be outdone, New York City Mayor Bill de Blasio is taking it one step further, pledging to fine businesses that don’t use a person’s preferred pronoun.

This effort to control the way we use language is central to the task of shifting how we think about transgenderism and forcing the acceptance of what some think is a mental disorder, not a true reality. But it also throws new obstacles into the path of teachers, who already have to navigate around accusations of political incorrectness and micro-aggressions.

According to the administration’s guidelines, schools aren’t allowed to require students to undergo a medical diagnosis, receive medical treatment, or produce a birth certificate before acquiescing to a student’s request (or the parents’ request on the child’s behalf) that they be referred to by a given pronoun (he or she, for example).

What A Social Mess

So, what would be required? It’s not clear if students would have to go through some bureaucratic process to request the change, or whether that would be considered a violation of their civil rights. Perhaps students simply have to tell their teacher what pronoun to use, but again this seems like it could be “triggering” for the student. Or maybe the teacher is just supposed to figure it out. But this too is fraught with problems. How does a teacher determine how a 5-, 10-, or 15-year-old gender-identifies?
